LEAD
BASED PAINT ABATEMENT
New regulations
has created additional concerns for building
owner and contractors. The regulations requires
testing of building materials that may contain
lead based paint before any renovation work
is done. A new law requiring Landlords,
Sellers, Realtors, and Building Managers
to inspect for lead and disclose the results
to all tenants and buyers of residential
properties. The disclosure law is in effect
now and you may contact A.Q. Management
& Control for information on the new disclosure
requirements. When lead paint are found,
and removal is needed, proper removal must
be done by a certified contractor. Part
of proper removal is; (a) worker protection,
protective clothing, respirators, filters
etc., (b) biological testing and air monitoring
for lead, (c) engineering controls to prevent
exposure, (d) record keeping of medical
and other records, (e) worker training,
and many more requirements. When the requirements
are not met by a contractor or owner, severe
fines may be implemented. Fines in the seven
digits has recently been set by OSHA. A
Pittsburgh, PA painting firm was fined $5.000.000.00
for subjecting its employees to lead exposure,
for failing to provide proper engineering
controls, proper training and proper respiratory
protection.
The OSHA Lead Standard
(29 CFR 1910.1025) for the General Industry
was designed to regulate workplace exposures
to lead. It has since 1978 been the principal
source of guidance for establishing the
"standard of care". The United States Federal
Emergency Regulations, Title X and Title
XVII, from 1994, affect housing built before
1978. The regulations were triggered by
many reports of high lead blood levels in
children. The United States federal Occupational
Safety and Health Administration under the
Department of Labor issued a Final Interim
Lead in Construction Standard (29 CFR 1926.62)
in June of 1993, cover all construction
work where workers may be exposed to lead.
The standard include; Permissible Exposure
Limits as determined by air monitoring,
engineering controls to reduce airborne
lead, grade the type of work in different
risk levels, respiratory protection, protective
clothing, cleanup facilities, medical surveillance,
biological monitoring, worker training and
more.
